The Recording Industry Association of America sent out their latest round of pre-litigation settlements two weeks ago to 32 students and the deadline to settle is Monday, according to Pam Gerace of Student Legal Services.
Gerace is urging students to seek the help of Legal Services before the 5 p.m. deadline.
“A third of the students have come in, but those who have not come in cannot just ignore the letter,” Gerace said. “They’re not going to go away.”
The settlement cost is $3,000 according to Gerace, and will move to $4,000 after the 5 p.m. deadline. She then predicts it will be another two or three weeks before the lawsuits are issued.
This new group of settlements came just weeks after the RIAA filed lawsuits on 34 students, and a month after eight students with pending lawsuits from August had filed a motion to quash.
The motion to quash, led by Greensboro attorney Stephen Robertson, aims to defeat the lawsuits in court, meaning students wouldn’t have to pay the fee.
“They’re trying to cram in as many settlements before the motion to quash is decided on,” Gerace said.
David Drooz, of the Office of Legal Affairs, does not think the school will receive the official subpoena for the 34 lawsuits until the motion to quash is settled.
“If [the RIAA] loses the August subpoena, they will likely revise the October one to get around whatever defect the court may identify in the August subpoena,” Drooz said.
According to Gerace, there is still no word yet on when the motion to quash will be settled. She said she doesn’t think the RIAA has submitted a brief to the judge and that it could still be eight to nine more months for the judge to come to a decision.
“My reasoning is that if RIAA loses on the August subpoena, then they would lose on the October subpoena,” Drooz said. “Better for them to wait. So far they have waited — I’ve not received a finalized version of the October subpoena.”
