A member of the men’s tennis team has been charged with a sex crime against one of his own teammates.
According to Jim Sughrue, public information officer for the Raleigh Police Department, Dejon Bivens was arrested on Oct. 27 and charged with a count of crimes against nature.
The details of a police report revealed that officers responded to a call from the victim’s apartment at 7 a.m. Bivens was arrested after investigation on the scene, where he refused to provide a saliva sample.
Sughrue said it is not uncommon for suspects to deny such requests.
“It varies,” he said. “Some people will provide it [voluntarily], and others will not.”
Detective G.R. Bowman of the RPD subsequently issued a search warrant in an attempt to secure a sample of the Bivens’ saliva. The sample was successfully retrieved.
The warrant further revealed the details of the incident.
The victim was having a party in his apartment the night of the incident, and he told police that he went to bed around 3 a.m. on Oct. 27.
Upon entering his room, he said he found the suspect sleeping in his closet. The victim stated that once he was in his bed, he heard the suspect leave the closet and lay down on the floor next to the his bed.
The victim told officers that he awoke at 5 a.m. and found Bivens leaning over him, performing oral sex.
The victim fled the bedroom to inform others in the apartment of the incident. He then went back into his bedroom, found Bivens pretending to be asleep, and began striking him.
Bivens, a freshman, is a former tennis standout from Charlotte Country Day High School. During his junior and senior years he amassed a record of 28-1 and has earned many sportsmanship awards during his tennis career.
Bivens’ charge, crimes against nature, is a Class I felony under section 14-177 of the North Carolina General Statues.
Bivens now awaits his trial date, which is slated for Nov. 19. He is still listed on the team’s roster.
